Until recently, Pennsylvania Courts were not able to decide issues related to custody of pets.

New laws have been passed that allow pets to be covered in Protection From Abuse Orders. Additionally, in divorce cases, the courts can now award ownership of pets.
Prior to the recent enactment of the laws, I had to tell clients that in the eyes of the court, their beloved pet is no different than an object of furniture when it comes to the law. The new laws now consider pets to be family members
HOWEVER, if parties are not married and they separate, if there is not a Protection From Abuse case, a civil case, called a replevin action would need to be filed to determine ownership, if an agreement cannot be reached. Whoever has the receipt for the pet, or signed the original adoption papers will be awarded the pet. If a dog is involved, it will be important to have the dog legally licensed.
